1. Introduction

At Zenvo Automotive A/S (“Zenvo”, “we”, “us” or “our”), we make data security and confidentiality a high priority. This Privacy Policy explains how we collect, use, share and protect personal data about you — such as your name, email address and phone number — when you visit or interact with our website zenvoautomotive.com and any of its subdomains, including our vehicle configurator at configurator.zenvoautomotive.com (together, the “Websites”), and when you purchase products from our online store, when available.

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Danish Data Protection Act. For the processing described in this Policy, Zenvo Automotive A/S acts as the data controller. If you have any questions about how we handle your personal data, you can contact us using the details in section 2.

3. The Personal Data We Collect

Information you give to us. We collect the personal information that you choose to provide to us when you:

  • contact us through our contact form, by email or by phone — we collect your name, email address, phone number and the content of your enquiry;
  • subscribe to our newsletter — we collect your name and email address;
  • create, save or submit a vehicle configuration on configurator.zenvoautomotive.com — we collect your name, email address, phone number, country and the details of your configuration;
  • request information about our vehicles or dealers, or register for an event or test drive — we collect your name, contact details and your stated preferences;
  • apply for a position with us — we collect your name, contact details, CV and the other information contained in your application; and
  • purchase products from our online store, when available — we collect your name, billing and delivery address, email address, phone number and order details. Payment card details are processed securely by our payment service provider and are not stored by us.

Information we collect automatically. When you use our Websites, we automatically collect certain data about your visit, such as your IP address, browser type, operating system, device type, the pages you visit and your interaction with our content and advertisements. We collect this data using cookies and similar technologies, and — apart from cookies that are strictly necessary for the Websites to function — only where you have given your consent through our cookie banner. See section 6 below.

4. Purposes and Legal Bases for Processing

We use your personal data for the following purposes and rely on the following legal bases under the GDPR:

  • Responding to your enquiries and providing the information or services you request — performance of a contract or steps taken at your request before entering into a contract (art. 6(1)(b)) and our legitimate interest in serving prospective customers (art. 6(1)(f));
  • Operating the configurator, including saving your configuration and following up on it with you — steps taken at your request (art. 6(1)(b)) and our legitimate interest in following up on your interest in our vehicles (art. 6(1)(f));
  • Delivering products and services you purchase, administering your order and communicating with you about your purchase — performance of a contract (art. 6(1)(b));
  • Sending you newsletters and other direct marketing, including tailored offers and targeted communication on social media and other digital channels — your consent (art. 6(1)(a)), which you can withdraw at any time;
  • Producing statistics and analyses to improve our Websites, products and user experience — your consent to analytics cookies (art. 6(1)(a)) and our legitimate interest in aggregated, non-identifiable statistics (art. 6(1)(f));
  • Recruitment — steps taken at your request prior to entering into an employment contract (art. 6(1)(b)) and our legitimate interest in assessing candidates (art. 6(1)(f)); and
  • Complying with legal obligations, for example under bookkeeping and accounting legislation — art. 6(1)(c).

5. Newsletters and Marketing

We will only use your name, email address and phone number to send you marketing material such as newsletters if you have given us your prior, express consent. If you have consented, we may tailor the content to you based on the information we hold about you, such as your interests, your saved configurations and, where relevant, your past purchases and demographic information (profiling).

You can withdraw your consent at any time by using the unsubscribe link included in every newsletter, or by contacting us at [email protected]. Withdrawal does not affect the lawfulness of the processing carried out before the withdrawal.

6. Cookies

Our Websites use cookies and similar technologies. When you first visit our Websites, you will be presented with a cookie banner where you can accept or decline the use of cookies that are not strictly necessary. We only set non-essential cookies — such as statistics and marketing cookies — if you have given your consent, and you can change or withdraw your consent at any time via the cookie settings on our Websites.

7. Who We Share Your Data With

We share your personal data only where necessary, and only with:

  • companies affiliated with Zenvo Automotive A/S, including subsidiaries, and the internal departments that need the data to perform their tasks;
  • our authorised dealers and distributors, where this is necessary to respond to an enquiry you have made — for example a purchase enquiry, a submitted configuration or a test-drive request;
  • service providers who process data on our behalf as data processors, such as providers of IT and hosting services, email marketing platforms, analytics services, payment services and logistics; and
  • public authorities, where we are required to do so by law.

All data processors act under a data processing agreement in accordance with art. 28 GDPR and may only process your data according to our documented instructions.

8. Transfers to Countries Outside the EU/EEA

Some of our service providers are located outside the EU/EEA, in particular in the United States. For example, we use the email marketing platform Mailchimp (Intuit Inc.) to send our newsletters.

Where personal data is transferred to a country outside the EU/EEA, we ensure that a valid transfer mechanism under Chapter V of the GDPR is in place — for example the EU–U.S. Data Privacy Framework, where the recipient is certified under it, or the European Commission’s Standard Contractual Clauses, supplemented by additional safeguards where necessary. You can obtain further information about our transfers, or a copy of the relevant safeguards, by contacting us.

9. How Long We Keep Your Data

We keep your personal data only for as long as it is necessary for the purposes described in section 4, after which it is deleted or anonymised. As a general rule:

  • enquiries and configurator data are kept for up to 2 years after our last contact with you;
  • data processed on the basis of your marketing consent is kept until you withdraw your consent, and documentation of your consent is kept for up to 2 years after it was last used;
  • purchase and transaction records are kept for 5 years plus the current financial year, as required by the Danish Bookkeeping Act; and
  • job applications are deleted when the recruitment process has been completed, normally within 6 months, unless you consent to us keeping your application for longer.

Data may be stored for longer periods in anonymised form, in which case it can no longer be linked to you.

10. Security

We have implemented appropriate technical and organisational security measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure and unauthorised access. Access to personal data is restricted to employees and processors with a legitimate need, and our internal procedures are reviewed on an ongoing basis.

11. Your Rights

Under the GDPR you have the following rights in relation to our processing of your personal data:

  • Access — the right to know what personal data we hold about you and to receive a copy of it;
  • Rectification — the right to have inaccurate or incomplete data about you corrected;
  • Erasure — the right to have your data deleted in certain circumstances (“the right to be forgotten”);
  • Restriction — the right to have the processing of your data restricted in certain circumstances;
  • Data portability — the right to receive the data you have provided to us in a structured, commonly used and machine-readable format, and to have it transmitted to another controller;
  • Objection — the right to object to processing based on our legitimate interests, and an unconditional right to object to processing for direct marketing purposes, including profiling; and
  • Withdrawal of consent — where processing is based on your consent, the right to withdraw it at any time.

We may update this Privacy Policy from time to time, for example to reflect changes in our processing activities or in applicable law. The current version will always be available on this page, together with the date on which it was last updated.
